Terms of Service

1. Introduction & Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between Flowbudd Inc., a Canadian corporation incorporated under the laws of Canada ("Flowbudd," "we," "us," or "our"), and you ("Customer," "you," or "your") governing your access to and use of the Flowbudd church management platform, including our website (flowbudd.com), mobile progressive web application, APIs, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1.1 Service Description

Flowbudd provides a comprehensive church management platform designed to help religious organizations manage their members, donations, events, communications, volunteers, and administrative operations. The Service includes:

  • Member and family management
  • Online giving and donation processing (powered by Stripe)
  • Event management and RSVP systems
  • Email and SMS messaging (powered by Resend and Twilio)
  • Volunteer and group management
  • Sermon and media library
  • smart administrative assistance (powered by OpenAI)
  • Social media scheduling and management
  • Analytics and reporting
  • Mobile-responsive progressive web application
  • API access (for applicable plan tiers)

1.2 Eligibility

You must be at least 18 years old and authorized to enter into binding contracts on behalf of your organization to use the Service. By using the Service, you represent and warrant that you have the legal authority to bind your organization to these Terms.

2. Account Registration & Access

2.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You agree to:

  • Provide truthful and accurate information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account
  • Not share your account credentials with unauthorized individuals

2.2 Organization Verification

For certain features (multi-entity management, denomination hierarchies, verified status), we may require verification of your organization's legitimacy. You agree to provide documentation upon request.

3. Subscription Plans & Billing

3.1 Subscription Tiers

Flowbudd offers multiple subscription tiers with varying features and pricing:

  • Launch Plan: $119 USD/month (or CAD equivalent)
  • Grow Plan: $197 USD/month (or CAD equivalent)
  • Multiply Plan: $397 USD/month (or CAD equivalent)

Current pricing and plan features are available at flowbudd.com/pricing. We reserve the right to modify pricing with 30 days' written notice to existing customers.

3.2 Billing & Payment

  • Billing Cycle: Monthly or annual (annual subscriptions receive discount)
  • Payment Method: Credit card or debit card via Stripe (our payment processor)
  • Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before renewal date
  • Currency: Billing in USD or CAD based on your location preference
  • Taxes: Prices exclude applicable taxes (GST/HST for Canadian customers, sales tax for US customers where applicable)

3.3 Free Trial

New customers may be eligible for a 14-day free trial. During the trial:

  • Full access to features of selected plan tier
  • No credit card required for trial start (required to continue after trial)
  • Trial automatically expires unless subscription activated
  • Trial may be canceled at any time without charge

3.4 Refund Policy

30-Day Money-Back Guarantee: If you are not satisfied with the Service within the first 30 days of your initial paid subscription, you may request a full refund by contacting support@flowbudd.com. After 30 days, subscriptions are non-refundable except as required by applicable law.

4. Data & Privacy

4.1 Data Ownership

You retain all ownership rights to Your Data. "Your Data" means all data, content, and information you upload, submit, or create through the Service, including member information, donation records, communications, events, and media content.

Flowbudd claims no ownership over Your Data.

4.2 Data Processing

Flowbudd processes Your Data solely to provide the Service as described in our Privacy Policy and Data Processing Agreement (DPA). You represent and warrant that:

  • You have obtained all necessary consents from individuals whose data you upload
  • Your use of the Service complies with applicable data protection laws (GDPR, CCPA, PIPEDA, etc.)
  • You are authorized to share Your Data with Flowbudd for processing

4.3 Data Location & Storage

Your Data is stored and processed using the following infrastructure:

  • Database: Neon Postgres (serverless PostgreSQL hosted in US data centers)
  • File Storage: Cloudflare R2 (object storage with global distribution, primary storage in US)
  • Hosting: Railway (backend hosting in US regions), Cloudflare Pages (frontend edge hosting globally)
  • Backups: Automated daily backups retained for 7 days (Neon point-in-time recovery)

While Flowbudd is a Canadian corporation, Your Data is primarily stored in United States data centers for performance and cost optimization.

4.4 Data Security

We implement industry-standard security measures including:

  • Encryption in transit (TLS 1.3)
  • Encryption at rest (database and file storage)
  • Regular security audits and penetration testing
  • Access controls and multi-factor authentication
  • DDoS protection via Cloudflare
  • Compliance with SOC 2 Type II standards (Year 3 target)

However, no system is 100% secure. You acknowledge the inherent risks of internet-based services.

4.5 Data Portability & Export

You may export Your Data at any time in standard formats (CSV, JSON, PDF) through the Service dashboard. We do not charge fees for data export.

4.6 Data Retention & Deletion

Upon termination of your subscription:

  • 30-Day Grace Period: Your Data remains accessible in read-only mode for 30 days
  • Data Deletion: After 30 days, Your Data is permanently deleted from production systems
  • Backup Retention: Backups may persist for up to 90 days for disaster recovery purposes, then permanently deleted
  • Legal Holds: Data may be retained longer if required by law or pending legal proceedings

5. Acceptable Use & Prohibited Conduct

5.1 Permitted Use

The Service is intended for lawful religious and nonprofit organizational purposes, including church, synagogue, mosque, temple, and religious organization management.

5.2 Prohibited Use

You agree NOT to use the Service for:

  • Any unlawful purpose or in violation of applicable laws
  • Harassment, abuse, or harm of individuals
  • Fraudulent or deceptive practices
  • Spamming or unsolicited communications
  • Violating intellectual property rights
  • Interfering with the Service or other users

6. Intellectual Property

6.1 Flowbudd's IP

Flowbudd retains all rights, title, and interest in the Service, including all software, designs, trademarks, and proprietary technology. These Terms do not grant you any ownership rights to the Service.

6.2 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal church management purposes.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWBUDD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may terminate your subscription at any time through your account dashboard.

We may suspend or terminate your access to the Service if you violate these Terms or engage in prohibited conduct.

9. Governing Law

These Terms are governed by the laws of Canada and the Province of Ontario. Any disputes shall be resolved through binding arbitration or in the courts of Ontario.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
